Yoto API Terms of Service
Effective as of June 26th, 2025
These Yoto API Terms of Service (API Terms) apply to your access and use of the Yoto application programming interfaces (APIs) and related documentation provided by Yoto Limited (Yoto, we, our, or us). By accessing or using our APIs, you agree to follow these API Terms.
If you are accessing or using the APIs on behalf of a company, organisation, or other entity, then “you” means that entity, and you represent that you have the authority to bind that entity to these API Terms.
1. Access to the Yoto APIs
Yoto provides access to certain APIs to allow you to build applications or services that interact with Yoto’s products, services, or content. Your access and use of the APIs must comply with these API Terms and any applicable documentation, policies, or guidelines we make available.
We may limit your access to the APIs (e.g., rate limits, quotas, or feature restrictions), and we reserve the right to modify, suspend, or discontinue the APIs at any time with or without notice.
When registering for API access, you must provide accurate, complete, and up-to-date personal and contact information. You are responsible for maintaining the accuracy of this information and must promptly update any changes to ensure we can contact you regarding security, compliance, or other important matters related to your API usage.
Contact Permission
By signing up to the API Access Programme, you grant Yoto permission to contact you via email (or other contact information provided), to deliver important updates, including but not limited to API changes and service modifications.
2. What Developers Shouldn’t Do
Developers must not:
Upload copyrighted or licensed content to another user's Yoto Card without rights’ holder authorisation.
Control players unless it is explicitly permitted by the user or owner.
Upload, generate, or make available any content that is not age-appropriate, child-safe, or that could reasonably be considered harmful, distressing, or unsuitable for children under 13.
Upload, generate, or make available any content that violates Yoto’s safety and content standards.
Share, sell, or misuse user data, including tracking user behavior without informed consent.
Store more user data than is strictly necessary for the app or service to function.
Share or disclose API keys publicly or with unauthorized parties.
Introduce cybersecurity vulnerabilities, including insecure handling of requests, credentials, or user data.
Fail to implement and maintain robust content moderation systems to prevent the dissemination of harmful, inappropriate, or illegal content, including mechanisms for users to report such content.
3. API Use Requirements
a. Compliance
You must use the Yoto APIs in accordance with applicable laws and regulations and must not use them in a way that could harm Yoto, its services, users, or partners. You must ensure that all content, applications, and services developed using the Yoto APIs are suitable for children and comply with all applicable child protection laws and guidelines, including but not limited to COPPA (US), GDPR and related EU directives (EU), and the UK Age Appropriate Design Code (UK). You must cooperate with Yoto in any compliance checks, audits, or investigations related to child safety, data privacy, or content standards.
b. Security
You are responsible for securing any API keys or user credentials provided by Yoto. These must not be shared, and any suspected breach or compromise must be reported to Yoto immediately. You must promptly report any actual or suspected child safety or data protection incident involving user data to Yoto at developers@yotoplay.com and cooperate fully in any investigation or remediation process.
c. Restrictions
You must not:
Reverse engineer, decompile, or extract source code from the APIs or underlying services.
Use the APIs for any purpose that is unlawful, deceptive, or otherwise harmful.
Circumvent rate limits or usage restrictions.
Cache, retain, or use user data beyond necessary functional needs.
4. Data Usage and Privacy
If your use of the APIs involves handling personal data, especially data relating to children under 16 (or under 13 in the US), you must: (a) Comply with all relevant data protection and privacy regulations, including but not limited to the GDPR (EU), UK Data Protection Act, UK Age Appropriate Design Code, and COPPA (US); (b) Obtain verifiable parental consent before collecting, using, or disclosing any personal data of children as required by law; (c) Implement data minimization, purpose limitation, and strong security measures for all children's data; (d) Provide clear, age-appropriate privacy notices to children and parents; (e) Not process, share, or retain children's data beyond what is strictly necessary for the app or service to function; (f) Promptly notify Yoto of any data breach or incident involving children's data and cooperate in any investigation or remediation; (g) Facilitate parental rights to access, correct, or delete their child's data as required by law.
5. Definitions
For the purposes of these API Terms:
"Child" or "children" means any individual under the age of 16, or under 13 where applicable by law.
"Children's data" means any personal data relating to a child.
"Parental consent" means verifiable consent obtained from a parent or legal guardian as required by law.
"Age-appropriate content" means content suitable for children, taking into account their age, maturity, and developmental needs, and compliant with Yoto's content standards.
6. Ownership and Licenses
All rights, title, and interest in the APIs and their underlying technology remain with Yoto. Subject to your compliance with these API Terms, Yoto grants you a limited, non-exclusive, revocable license to use the APIs solely for the development and operation of applications that interface with Yoto services.
You retain ownership of your applications but not of Yoto content or branding.
7. Support and Maintenance
a. Technical Support
Yoto provides standard technical support for the APIs through our developer portal and support email.
b. Maintenance
Yoto will use commercially reasonable efforts to provide advance notice of scheduled maintenance. Emergency maintenance may occur without prior notice.
c. Service Levels
Yoto does not guarantee any specific level of API availability.
8. Termination
We may revoke your access to the APIs at any time for violations of these API Terms, security risks, or business reasons. Upon termination, you must cease using the APIs and delete any data obtained through them, unless otherwise required by law or agreed with Yoto.
9. Changes
We may update these API Terms from time to time. Significant changes will be communicated through appropriate channels. Continued use of the APIs after such updates indicates acceptance of the revised terms.
10. Disclaimer and Limitation of Liability
a. Disclaimer
The Yoto APIs are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, reliability, non-infringement, or that the APIs will meet your requirements, be uninterrupted, timely, secure, or error-free.
You acknowledge and agree that your use of the APIs is at your sole risk, and that Yoto does not guarantee the availability, reliability, or performance of the APIs or any services they interface with. No oral or written advice or information obtained by you from Yoto or through the APIs shall create any warranty not expressly stated in these Terms.
b. Limitation of Liability
To the maximum extent permitted by applicable law, Yoto and its affiliates, directors, officers, employees, agents, licensors, and service providers shall not be liable to you or any third party for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages whatsoever, including but not limited to damages for:
Loss of profits, revenue, business, customers, goodwill, or anticipated savings;
Loss or corruption of data or software;
Service interruptions or downtime;
System failures or damages resulting from third-party integrations;
Security breaches, including unauthorized access to or use of your application or systems;
Any use or misuse of the APIs or data derived from them.
This applies whether such damages arise in contract, tort (including negligence), strict liability, or otherwise, even if Yoto has been advised of the possibility of such damages.
c. Cap on Liability
Notwithstanding anything to the contrary herein, Yoto’s total cumulative liability to you or any third party arising out of or relating to these API Terms, the APIs, or your use thereof shall not exceed one hundred British pounds sterling (£100 GBP) or the total fees (if any) paid by you to Yoto in the twelve (12) months prior to the event giving rise to the claim—whichever is greater.
d. Indemnity
You agree to indemnify, defend, and hold harmless Yoto and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
Your use of the APIs or any content you upload or distribute through them;
Your breach of these API Terms or applicable laws;
Any content, data, or applications created using the APIs that cause harm or violate the rights of others;
Any third-party claims related to your application’s use of the Yoto platform.
11. International Use
If you access the APIs outside the UK, you agree to comply with all relevant local laws. Yoto makes no representation that the APIs are appropriate or available for use in all jurisdictions.
All communication will be in English. Users are responsible for understanding all terms and instructions provided.
12. Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, terrorism, riots, war, or governmental action.
13. Assignment
You may not assign or transfer these API Terms or any rights or obligations under these Terms without Yoto's prior written consent. Yoto may assign these Terms without restriction.
14. Severability
If any provision of these API Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These API Terms constitute the entire agreement between you and Yoto regarding the APIs and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
16. Dispute Resolution
a. Initial Resolution In the event of any dispute arising from these Terms, the parties agree to first attempt to resolve the dispute informally by contacting each other.
b. Arbitration If the dispute cannot be resolved informally, it shall be settled by binding arbitration in London, UK, conducted in accordance with the rules of the London Court of International Arbitration.
c. Exceptions Nothing in this section prevents either party from seeking injunctive relief in cases of intellectual property infringement or other urgent legal matters.
17. Governing Law
These API Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England and Wales. If any part of these Terms is found invalid, the remainder shall remain in effect.
